​Based in the San Francisco Bay Area, Elliot Sands led The SHP Foundation and delivers assistance to those who are facing poverty and in need of homes. Focused on finding workable solutions to a seemingly intractable problem, Elliot Sands closely follows State initiatives in this sphere.

In August 2022, the Community Assistance, Recovery, and Empowerment (CARE) Court proposed by Governor Gavin Newsom was resoundingly approved by both sides of the state Legislature, with only two legislators voting against it. The aim of CARE Court is to develop a system specifically geared to address the needs of those with severe mental illness, who may live out on the streets.

The specifics of this bill involve a petition submitted to the court by behavioral health workers, family members, first responders, and close friends. The petition sets out to demonstrate that the person is either a threat to him or herself (or those of the community) or unlikely to safely survive without support. The documents must also include proof of the person having been recently detained and undergone intensive treatment, or an affidavit from a licensed health care worker who has examined them.

At this point, the court can order that the person undergo clinical evaluation, which determines whether CARE Court services apply. If a positive decision is reached, the participant receives both legal counsel and an advocate (or “supporter”) to serve as a guide. The Care Plan developed spans areas such as recommended medication, treatment, and housing (one key safeguard is that court-ordered drugs cannot be administered by force). Over the following year, participants must attend hearings and demonstrate their adherence to the plan. It is possible a person could be turned over by the court for conservatorship if they fail to meet basic criteria.

It is important to understand and sympathize with individuals living on the street and learn how to treat and help them properly. A little kindness can be a life-changing moment for such a person and restore their faith in humanity. A good step is to be friendly and acknowledge the person. It is noteworthy that homelessness does not diminish the dignity and integrity of those without a home, and acknowledging somebody can help brighten up their day.

Donating good food and warm clothes to a trusted support agency is also a good way to help people without a home, especially during the winter. Even the smallest acts of kindness can make a difference.
